Fiscal Impact: Federal Funds - $424,432 Background/Discussion: In June 2008, the District received $424,432 in FY 2006-07 Department of Homeland Security Transit Security Grant Program-Supplemental Program funds. These revenues are in addition to the FY 2006-07 initial allocations. The grant funds will be used to provide security awareness training to 80% of the District frontline employees, including bus operators, maintenance workers, first-line supervisors, and security guards. This training program was developed under the direction of Federal Department of Homeland Security Transit Security Administration.

GM Memo No. 08-200 Meeting Date: August 6, 2008 Page 2 of 2 The District will utilize a “Train the Trainer” course provided by the National Transit Institute, which is approved by the Department of Homeland Security as a certified course with a curriculum accepted by the State of California Governor’s Office of Homeland Security (OHS). Adoption of this Resolution will allow the District to complete the required application documents for submittal to OHS. Justification for Same Day Board Action. Section 5.5.4 permits, under certain circumstances, the consideration by the Board of an agenda item considered at a Board Standing Committee or Special Committee meeting held on the same day as the Board meeting. The pertinent portions of the section require: (1) the Board President to concur that extenuating circumstances require Board consideration of the item; (2) the extenuating circumstances are communicated to the Board in writing prior to the consideration of the item; and (3) a majority of the Board concur that extenuating circumstances exist and the item requires the Board’s immediate consideration. The extenuating circumstance justifying joint consideration of this item is: OHS has advised that sub-grantees submit a completed application package within 30 days after receiving the State award letter, which was dated on June 18, 2008. The Board has adopted Resolution No. 07-032 authorizing the necessary actions for the purpose of obtaining the balance of the FY 2006-07 Federal Homeland Security Grant Program funds and Resolution No. 08-053 is asking the Board’s approval to apply for additional funding. The Board President has concurred with staff recommendation that a majority of the Board concur that extenuating circumstances exist and the item requires the Board’s immediate consideration. ALAMEDA-CONTRA COSTA TRANSIT DISTRICT RESOLUTION NO. 08- 053 A RESOLUTION AUTHORIZING THE GENERAL MANAGER, OR AUTHORIZED DESIGNEE, TO EXECUTE ACTIONS NECESSARY FOR THE PURPOSE OF OBTAINING FEDERAL ASSISTANCE PROVIDED BY THE FEDERAL DEPARTMENT OF HOMELAND SECURITY AND SUBGRANTED THROUGH THE STATE OF CALIFORNIA, INCLUDING SUBMITTAL OF THE GRANT APPLICATION FOR FY 2006-07 TRANSIT SECURITY GRANT PROGRAM SUPPLEMENTAL FUNDING

WHEREAS, on January 4, 2006, the Board of Directors of the AlamedaContra Costa Transit District reviewed and approved staff’s recommended priority list for Department of Homeland Security grant projects for submission to Office of Homeland Security; and WHEREAS, in April 2006, the District received $970,000 in Department of Homeland Security grant funds for FY 2004-05, approved for expenditure toward two (2) District projects: Security equipment and NIMS training projects; and WHEREAS, in June 2007, the District received $546,000 in Department of Homeland Security grant funds for FY 2005-06, approved for expenditure toward installing a new card access system on District facilities; and WHEREAS, in June 2008, the District was awarded a grant in the amount of $424,432 from Department of Homeland Security FY 2006-07 Transit Security Grant Program – Supplemental Funding, approved for expenditure toward the security awareness training program; and WHEREAS, AC Transit is an eligible applicant of Department of Homeland Security Program funds; NOW THEREFORE, the Board of Directors of the Alameda-Contra Costa Transit District does resolve as follows: Section 1. The General Manager, or his designated representative, is authorized to file any necessary supporting documents under this resolution and to execute the Fund Agreement(s), and revisions, if any are required, to receive the Department of Homeland Security Program funds. Section 2. The Project receiving the Department Homeland Security funds is being completed on behalf of the general public and will not benefit a private entity or individuals.

Section 3. Upon allocation of funds by the State of California Office of Homeland Security, the District will have the authority to expend these funds.

Section 4. The following individuals at AC Transit are authorized to sign any necessary documents and conduct any communications regarding this grant.
