Notice of Availability Draft Environmental Impact Report State Clearinghouse No. 2010031050 December 14, 2010

Resource Recovery Park Project The County of San Benito (County) has prepared a Draft Environmental Impact Report (EIR) as Lead Agency under the California Environmental Quality Act (CEQA) for the Resource Recovery Park project. The purpose of the EIR is to identify the significant effects on the environment of the proposed project, to identify alternatives to the proposed project, and to indicate the manner in which those significant effects can be mitigated or avoided.

  Description of the Proposed Project The project would amend the County General Plan land use designation and change the zoning designation for the 30-acre site from Agricultural Productive (AP) to Heavy Industrial (M-2) which would allow for the phased development of a Resource Recovery Park (RRP) within the 30-acre site. The site is a portion of an approximately 100-acre parcel (APN 025-190-029) owned by the County and creation of one or more separate parcels may be considered as a component of the project. Specific uses of the RRP have not been determined; however, the RRP is intended to provide increased opportunities for materials recycling and to utilize energy resources associated with the John Smith Road Landfill. Potential facilities and activities at the RRP include: (1) receiving, processing, sorting and storage of construction and demolition materials, recyclable materials, green waste and wood waste; (2) development and operation of a reusable items collection center for building materials, appliances, furniture, clothing and other materials; and (3) operation of energy producing operations and manufacturing businesses that utilize landfill gas and/or biomass for manufacturing processes. The RRP could also provide for relocation of the County’s existing Household Hazardous Waste and electronic

waste facility to the RRP from its current location at the John Smith Road Landfill. Development of the RRP would require grading, paving and facilities development within the RRP site, as well as on-site utilities and drainage facilities installation. Off-site roadway and utility infrastructure improvements could be required for development of the RRP and the specific improvements would be dependent upon the types of facilities ultimately located within the RRP. It is anticipated that the County may license, lease, sell or jointly operate portions of the RRP to third parties for development and operation of facilities consistent with the purpose of the RRP.

  Availability of the Draft EIR The Draft EIR is available for public review online at the County’s website: http://www.san-benito.ca.us/ The Draft EIR is being circulated for review and comment to the public, agencies, individuals, and interest groups who have requested to be notified. Per Section 15105 of the State CEQA Guidelines, San Benito County will provide for a 45-day public review period on the Draft EIR. The public comment period for the Draft EIR ends on January 28, 2010. During the public review period, the County Planning Commission will hold a public meeting to explain the contents of the Draft EIR and to receive oral and written comments on the Draft EIR. The public meeting will be held at the following time and location:   January 19, 2010

Impacts of the Proposed Project The proposed project would result in 24 significant Project-specific and two significant cumulative impacts. Mitigation measures are identified which would reduce 22 of the significant project-specific impacts to less-than-significant levels. A total of two projectspecific and two cumulative impacts would remain significant and unavoidable. Significant and unavoidable impacts of the project are: •

The proposed project would have the potential to expose existing residences to noise levels associated with the on-site operations in excess of the County Zoning Ordinance Criteria;



The proposed project area has the potential to result in permanent alteration of existing visual character of the project site as viewed from adjacent areas;



Project-generated emissions of greenhouse gas (GHG) emissions could conflict with regulations or requirements adopted to implement a statewide, regional or local plan for the reduction or mitigation of greenhouse gas emissions; and



Implementation of the proposed project components combined with other past, present and probable future development in the County of San Benito would result in significant cumulative impacts to the visual character and scenic vistas of the region.
