AN ORDINANCE AMENDING THE ZONING ORDINANCE OF MADISON COUNTY, GEORGIA. For the purpose of promoting the health, safety, and general welfare of the present and future inhabitants of Madison County and to further the purposes of the Madison County Zoning Ordinance as set forth therein, the Board of Commissioners of Madison County does hereby ordain and enact into law the following changes to the Zoning Ordinance. ITEM ONE. All current poultry houses and hog parlors are grandfathered in. ITEM TWO. Section 7.1.1.3 shall be changed to read as the following; Agricultural uses including forestry, commercial greenhouse and plant nurseries (wholesale and retail), livestock and poultry grazing, feed lots, turkey ranges, and animal waste lagoons, provided that no structure housing poultry or other livestock (hog parlors) or containing manure or other dust producing substance is located closer than four hundred (400) ft. from an existing dwelling unit other than that of the property owner or two hundred (200) ft. six hundred (600) ft. from any common property line. The end of the structure with the exhaust fans is to be one thousand (1000) ft. from the property line. A fence erected for the purpose of containing livestock or for delineating agricultural properties are exempt from the four six hundred (400) (600) ft. requirement. If a residence, other than that of the property owner, is constructed closer than four hundred (400) ft. to an existing structure housing poultry or livestock, or existing turkey ranges, or animal waste lagoons, the four hundred (400) ft. buffer distance requirement shall not apply. Structures housing livestock only, excluding hog parlors and other uses identified above, shall be located no closer than fifty (50) ft. from any adjacent property line. There shall be a vegetative and/or natural barrier between poultry houses and the road frontage. No poultry or hog farms shall be allowed within one (1) mile of any municipality within Madison County.

ITEM THREE. Section 7.1.1.21 shall be added to read as follows; No parcels shall be rezoned to A-1 unless total acreage or combined acreage equals 50 fifty (50) acres or more. ITEM FOUR. Section 7.1.1.22 shall be added to read as follows; A-1 parcels that sit idle from intensive operations for twelve (12) months will revert/ or be rezoned to A-2 property.

ITEM FIVE. Section 7.1.1.23 shall be added to read as follows; There will be no rezone to A-1 with in the residential or commercial character area of the Land Use Map. ITEM FIVE. Should any sentence, section, subsection or provision of this Resolution or application thereof be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration shall not affect the validity of the Zoning Ordinance of Madison County, as amended, as a whole nor any part thereof that is not specifically declared to be invalid or unconstitutional. ITEM SIX. This amendment of the Zoning Ordinance of Madison County, Georgia, shall take effect and shall be enforced from and after the date of its adoption, the public welfare demanding it.
