RENTAL AGREEMENT Please allow this contract to verify your acceptance of the following Rental agreement: COMPANY: Golden Vintage Group LLC (hereinafter “GVG”), c/o David M. Paratore, Managing Member, Vintage Lounge, 72 Broad Street , Boston, Massachusetts 02110. CUSTOMER: Danny Le (ss#031-64-0371)& Hosheus Isaac (026-74-4134) (hereinafter “CUSTOMER”), 3407 36th ave, Astoria, Queens 11106 DATE: April 4th 2009from 11:00 pm to 1:45am April 5th 2009. LOCATION: Vintage Lounge, 72 Broad Street, Boston, MA 02110 FEE: CUSTOMER agrees to exclusively promote an event at Vintage Lounge for the date and time specified above. Customer furthermore guarantees a minimum bar spend of Five Thousand Dollars ($5,000.00USD pre tax and gratuity.) A Two thousand Five Hundred dollar ($2,500.00) deposit is due at the time of signing in the form of cash or certified check. Any failure to reach the identified bar minimum would mean forfeiture of the deposit and or the collected cover charge. RESPONSIBILITIES: GVG agrees to provide access to the venue for CUSTOMERS guests throughout the course of the event, and never more than legal occupancy would safely allow at any given time. GVG will provide bartenders, service and security staff for the event and reserve the right to reject admittance, refuse bar service to, and or eject any invited guest for any reason they see fit. CUSTOMER will supply one Dj for the event at their own cost and with all his own equipment. GVG will collect a cover charge (not to exceed $20 per person) at the door, the equal of which will be paid to CUSTOMER within 48 hours of the event provided that the minimum spend is reached. GVG will be responsible for checking Identification of all invited guests and Customers associates prior to entrance, failure to produce ID will result in rejection of admission or ejection from the venue. ALL guest, promoters and staff MUST have proper Dress to gain entrance. Proper dress includes but is not limited to NO; work boots, hats, wave caps, athletic attire, sneakers, jerseys, fatigues, or hoods. All male guests must have a collared shirt to enter. Customer agrees that all marketing materials must be approved in writing by VL before distribution by Customer. Failure to obtain such approval first would result in loss of deposit. INDEMNIFICATION: Customer hereby agrees to indemnify and hold harmless GVG and/or its representatives from and against all claims, costs, expenses, suits, losses and damages arising out of designated rental. UNFORESEEN CIRCUMSTANCES: In the event of unforeseen circumstances beyond GVG control, including but not limited to natural disasters, documented serious illness and/or hospitalization of management, GVG reserves the right to cancel and refund any and all monies already paid to them. Entire Agreement; Amendment. This Agreement contains the entire understanding of the parties with respect to the subject matter hereof and supersedes any and all prior agreements, contracts and understandings, whether written or oral, between the parties with respect to the same. This Agreement may only be amended by a written instrument signed by all of the parties hereto. This includes the sale of additional tickets and or pricing specials.
