ORDER The Tenth Circuit remanded this case, directing the court to determine the proper sanction to be assessed for plaintiff Medical Supply Chain, Inc.’s inclusion of one of the defendants, Jeffrey Immelt, as a defendant in his individual capacity. On January 9, 2007, the court ordered defendant Immelt to submit a statement indicating whether he still intends to pursue sanctions in this case, and, if appropriate, to submit affidavits providing the court with information on reasonable attorney fees and costs incurred. On January 19, 2007, Defendant Immelt responded that he does not wish to pursue sanctions in this case. The court therefore finds that defendant Immelt’s previous request for sanctions is moot.
