McGarvey Construction Company, Inc. 401(k) Salary Reduction Plan PARTICIPANT NOTICE REGARDING DEFAULT INVESTMENTS This notice provides information on what happens to your retirement funds in your company’s defined contribution plan if you fail to make elections for the investment of your funds. As a participant in your employer’s Plan, you have the right to decide how your salary deferrals and any company contributions allocated to you are invested. In the situations where you fail to provide investment directions, your funds will be invested in your Plan’s “default investment.” If you do not provide investment directions to Mutual of Omaha for these contributions within at least 30 days after this notice, your funds will be invested in a “default investment” selected by your employer. Your Plan’s default investment is the target maturity fund series known as the Vanguard Target Retirement funds. The default investment is intended to qualify as a “qualified default investment alternative” or “QDIA” under Department of Labor regulations. The QDIA is described in more detail below in the paragraph titled “Description of the QDIA.”

You can transfer your funds out of the default investment and into another investment alternative available under your Plan at any time without financial penalty, by contacting the Mutual of Omaha Participant Call Center at 888-917-7191 or via www.GetRetirementRight.com. You can find information about the Plan’s other investment alternatives by visiting your Plan provider’s Web site at www.GetRetirementRight.com. Description of the QDIA – The QDIA selected by your employer as the Plan’s default investment is the target maturity fund series known as the Vanguard Target Retirement funds. The funds are issued in five year intervals, beginning with 2015 and ending with 2060, with each fund targeting a specific retirement date. For example, the Vanguard Target Retirement 2035 Fund is designed for those participants who plan to retire within five years of the year 2035. The default investment for a participant will be the fund with the target maturity date nearest the date the participant attains age . Each Vanguard Target Retirement fund invests in other funds that provide a diversified mix of asset classes and investment styles, including fixed income investments and domestic and foreign equity investments. The mix will gradually become more conservative as the target retirement date nears. Each Fund seeks to provide capital appreciation and current income consistent with its current asset allocation. The investment fee charged by each fund will vary based on the fees charged by the underlying funds. Please refer to the additional information for the fees associated with these funds.

This information will be updated at least annually and more frequently if certain information changes. General Plan Information This section describes any limitations or restrictions on how you can manage your account along with information on the plan’s investment options and any voting rights that may apply to them. If your plan offers a brokerage account option, information regarding this account can also be found in this section.

Administrative Expenses The information in this section provides detail on expenses associated with the administration and recordkeeping of the plan and, if deducted from your account, how these expenses will be calculated. Please note that administrative expenses may not be deducted from your account and instead be paid by your employer. Whether or not these expenses are deducted from your account may also vary from year to year.

Individual Expenses In this section you will find a listing of services available to help you manage your retirement account and the cost for each service. These services are optional and you will only be charged if they are used.

Investment Options The charts in this section are designed to provide detailed information on the investments available through your company’s plan. This section is broken out by investment type and includes such information as investment returns, performance of comparative benchmarks and where to obtain additional information on each investment.

General Plan Information Investment Instructions Upon meeting the eligibility requirements of your company’s plan and completing all required enrollment documents, you are responsible for choosing how to invest the assets in your account. Your investment decisions are subject to any limitations or restrictions described in the table below. Exercise of Voting and Other Rights Certain voting rights may apply to an investment option that you have CHOSEN for your account. If the investment option is not a mutual fund, the voting rights will be exercised by the investment manager(s) of the investment option. United of Omaha Life Insurance Company will exercise any voting rights for investment options that are mutual funds.

Designated Investments For a list of investment options offered through the plan, please review the Variable Return Investment Table in Part 1 of this document.

Investment Managers For the investment managers of the plan’s investment options, please see each investment’s website, prospectus or fact sheet. Fund profiles are available at www.getretirementright.com/funds/45. The fund name on the performance chart is a link to the fund profile. U

Administrative Expenses Expenses for administrative services provided to the plan may be charged to your account. These services include recordkeeping (e.g., valuing participant accounts, processing contributions and investment transactions and providing account statements), legal (e.g., design changes required by law and interpreting the plan document) and accounting (e.g., auditing the plan’s financial records). If administrative expenses are charged to plan participants, they will be shown on the quarterly account statement and charged either pro rata based on the amount of each participant’s account balance relative to total plan assets, or per capita based on the number of the participants in the plan. The payment method will be determined by the plan administrator at the time the expense is due.

There are no redemption fees or Maximum & Deferred Sales charges applicable to the funds listed above. However, in the event of an employer-directed withdrawal (as defined by the plan's annuity contract), a market value adjustment may be applicable to the Guaranteed Account. Any market value adjustment will be calculated in accordance with the terms of the plan's annuity contract. The Total Annual Operating Expense ratio is the percentage of fund assets paid for operating expenses and management fees. This ratio typically includes the following types of fees and expenses: accounting, administrator, advisor, auditor, board of directors, custodial, distribution, legal, organizational, professional, registration, shareholder reporting, subadvisor and transfer agency.
