The HIPAA Privacy Rule Part 5 Welcome to part five of a five-day series on HIPAA, the “no-privacy” Rule. The rule allows your data to be computerized and shared. But after doctors refused to use electronic medical records, Obamaʼs 2009 stimulus bill penalizes doctors who donʼt. It also adds new intruders. Due to HIPAA and the stimulus bill, 2.2 million entities can share your data. The Washington Post calls the stimulus, “The Machinery Behind HealthCare Reform,” saying it will allow “unprecedented data-mining…into the practice of doctors, the kind of surveillance” that will also “enable insurers to cut costs by controlling more precisely the care that patients receive.” Thus HIPAA and the stimulus formed the foundation of Obamacare. “Health Insurance Portability and Accountability Act of 1996,” Public Law 104-191, August 21, 1996. “The Privacy Rule,” U.S. Department of Health and Human Services Website, HHS.gov, Accessed June 28, 2013. “The Machinery Behind Health-Care Reform,” Robert OʼHarrow Jr, The Washington Post, May 16, 2009. “Health Information Technology for Economic and Clinical Health Act (HITECH),” The American Recovery and Reinvestment Act of 2009 ( “stimulus” ), signed into law February 17, 2009.
