Why Trump Isn’t Required to Enforce Obamacare A judge will soon rule on Texas v. United States, the lawsuit against Obamacare filed by 20 state attorneys general. But Democrats soon in charge of the U.S. House are working to challenge the expected ruling and to require the Trump administration to defend the law. They have also issued a letter to the acting U.S. Attorney General. The letter states that when there’s a conflict between the U.S. Constitution and the Acts of Congress, the AG’s responsibilities can best be discharged by defending the Acts of Congress. So they say, but there are three separate, yet equal, branches of the U.S. government for a reason. The executive branch is not required to enforce an unconstitutional Act of Congress.
