Congressional Lawyer Says No Right to Health Care Welcome to the Health Freedom Minute. This is Twila Brase president of Citizensʼ Council on Health Care. A Knoxville, Tennessee attorney has filed a lawsuit against ObamaCare. More than 31,000 plaintiffs have joined the suit. The attorney argues that “Congress has absolutely no constitutional authority to regulate health care. Period.” Regulation of health, welfare, education, and crime, he says, is a police power retained by the states. A Congressional Research Service report undergirds his argument.¹ Attorney Kathleen Swendiman writes, “The U.S. Constitution does not explicitly address a right to health care.
