Three Protective Steps for Patients Patients have legal rights they often don’t exercise. First, they can demand that information for an appointment be kept private from their health plan—if they pay cash IN FULL on the day of their appointment. Second, they can refuse to sign the HIPAA form or the embedded Notice of Privacy Practices statement. There is no legal requirement to sign and not signing indicates a desire to keep personal information private. Third, if patients are members of health sharing organizations, they are not required and should not tell the hospital about their membership. Members are uninsured. Hospital should perceive these patients as the uninsured patients they are and give them a cash-based price for care.
