ACA Supporters Offer Three Ways to Save Obamacare Two law professors offer three ways for Democrats to save the Affordable Care Act. A federal judge ruled that the mandate to purchase health insurance is “unconstitutional,” and since it can’t be separated from the rest of the law, the entire law is “invalid.” These two pro-Obamacare professors say Congress can save the law by “saving, severing, or sinking the mandate.” Congress could pass a bill to raise the penalty from zero to one dollar, declare the mandate severable, or repeal the mandate altogether and leave the rest of the law intact. But, as I said yesterday, Democrats would have to get one of these options through a Republican Senate and signed by President Trump.
