Will Minnesota Legislature Eliminate Patient Consent? Most people think the so-called federal HIPAA privacy rule protects their medical information, but that’s not true. HIPAA is a permissive datasharing rule. It eliminates the requirement for patient consent. Yet because most Americans think it protects privacy, many states have repealed state patient-consent requirements in favor of HIPAA. This has allowed patient data to be shared with perhaps millions of people for PURPOSES that have nothing to do with patient care. Minnesota legislators are trying to eliminate the state’s strong patientconsent law, making every diagnosis, treatment, and conversation patients have with doctors available for outside analysis, tracking, profiling, profiteering—and government controls on care.
