LICENCE FOR RUNNING AND MAINTENANCE OF RUNNING OF PANCHVATI GUEST HOUSE OF CANTONMENT BOARD DAGSHAI Introduction The Cantonment Board Guest House “Panchvati” renovated during the year 2012-2013. Due to establishment constraints, it has been decided to maintain the same by outsourcing. The Guest House consists of four rooms, kitchen, store, lobby cum reception centre, dinning room, parking space etc. It will cater mainly to the needs of visiting of IDES officers. Therefore licensee shall be bound to provide boarding and lodging facilities to the officers on the basis of following priority and rates mentioned against each :General terms 1. 2. 3. 4. 5. 6.

The contractor shall provide the accommodation in above Guest House to first category within a notice of the 24 hrs. The Chief Executive Officer shall be at liberty to decrease the time limit in suitable case or during emergency. Obligation of Cantt Board Dagshai The department shall provide I. II. III. IV. V. VI. Furnished room with fixtures, furniture etc. Gas connection, bucket and other contingencies as available but contractor is responsible for maintenance of the same. NOC for telephone will be accorded by the Chief Executive Officer. Payment of electric and telephone bills will be made by the contractor. However contractor will only charge the actual amount of telephone calls from guest. Initial provision of linen, furniture, towel, paintings, almirahs. Provision of flower bed hedges and plants. A set of four garden chairs with table for outside open space.

The CEO shall have absolute rights and powers for revocation of security/bank guarantee in case of breach of any clause of this contract without any prior notice to the contractor and no claim what so ever shall be entertained. The intending bidders will have to deposit Rs. 2,00,000 only as temporary earnest money in shape of Bank Draft/Call Deposit to be drawn in favor of Chief Executive Officer Dagshai in the office of Cantt. Board Dagshai before the commencement of the auction which will be refunded after the completion of the bid or adjusted towards the amount of the bid as the case may be. The highest bidder shall have to deposit full amount of the accepted bid at the fall of hammer. Decision of CEO with regard to determining the quality and service shall be final and acceptable to the contractor. CEO shall also reserve the rights to get work/service done/replaced at his own level at the risk and cost of the contractor after giving notice in writing. Expenditure incurred shall be recovered from security which shall be make good by the contractor. With regard to employee contractor shall ensure proper identification, police verification and medical fitness etc. CEO or any person authorized by him shall be at liberty to carryout any surprise check. A person deployed by the contractor shall be employee of contractor for all intent and purposes. There shall be no relationship of employer and employee between the said person and the Board either implicitly or explicitly. The contractor shall be responsible for fulfilling all his obligations towards the person deployed by him. The contractor shall arrange the disbursement of wages to his staff so deployed for duty by 7th of every month. In case person deployed by contractor does not come upto the mark, perform his duties properly, indulge any unlawful act or disorderly conduct shall be removed immediately. The contractor shall keep the Board indemnified against all losses caused to the Board’s property by way of theft mishandling or otherwise. License fee shall be deposited quarterly in advance at least 10 days before the commence of next quarter. In case in the matter of any dispute Board is also made a party and suppose to contest the case, the cost if any of the actual expenses incurred towards counsel fee and expenses shall be paid to the Board in advance and on demand. The contractor shall ensure that no financial or legal liability come upon guest house and the Board in any nature what so ever for the act of the contractor or his employee. Cantonment Board shall not be responsible for any injury or loss of life of any contractor employee. In event of exigencies arising due to death, infirmity, insolvency for any reason, liabilities thereafter contract shall be bond by the following on the terms as Board may think proper in public interest or revoke the contract. a. Legal heir in case of sole proprietor b. Next partner in case of company or firm c. In case of partner. Constitution will not be charged without prior permission of the Board. In event of any dispute or differences rising out of this contract/agreement, the same shall be referred to the soul arbitration of the PCB or his nominee duly appointed by him. The award of such arbitrator shall final and binding on the

parties thereto. During performance of the contract, contractor shall at his own cost and initiative fully comply with the all applicable laws of the land and with any by laws rules regulations and orders provisions having force of law made by the Govt. or its statutory body. Conditions of the auction shall be deemed to be the part of the licence deed/agreement. License fee will be increased @ 5% every year.

Obligation of Licensee 1. Cooking and service staff will be deployed in such a way so as to ensure smooth and efficient serving of breakfast, lunch, dinner and tea etc. to the guest as per prescribed rates. 2. Maintenance and cleaning on daily basis of all rooms including toilets, corridor, glass panes, toilets door, windows, road open place hut and whatever inside the premises. Contractor shall use the disinfectant, air freshner, toilet cleaners, phenyl for maintenance of hygienic condition. 3. Contractor will also maintain the flower bed hedges and plants as planted in the premises. He will also ensure that seasonal saplings are replaced and maintained properly at due time if any plant is dried or damaged that should be replaced. 4. Bed rooms linen and bath towel will be changed every alternative days, when ever the rooms are in use. 5. However fresh set of linen and towel shall be provided for each new occupant. 6. Linen and other associate items will be cleaned after every checkout using good quality of detergent and to be kept properly ironed and folded. Beside this all curtain, blanket, quilt will be clean/wash as per schedule here under:-

(d) Carpet, rugs, where ever provided will be brushed/vaccum cleaned daily. (e) Kitchen will be always kept spick, span at all times. (f) Utensils, crockery, cutlery and other kitchen gadgets will be kept clean all the time (g) Cooking will be done in hygienic condition by trained cook. (h) Services will be provided by, clean, properly dressed and in hygienic manner/condition. (i) Contractor will subscribe one daily newspapers in common room and will also provide the newspaper on demand to the occupant. Charge for the same can be included in the bill of the guest. (j) laundry and other services shall be made available at actual rates to the visitor if required by them. (k) It will be responsibility of licensee to present the bill straight to the visitor. Separately for room rent food bill etc. and will collect the payment. (l) Meals and beverages will be charged as per rate fixed by the Chief Executive Officer/Board.

(n) Visitors record, telephone record, electricity bills and other documents shall be kept in guest house under custody of the licensee. Any record pertaining as above or directed by CEO shall be put up before him or his rep immediately. (o) Repair and maintenance during the period of contract shall be the responsibility of the contractor.

(p) On expiry of contract/licence will hand over the peaceful vacant possession alongwith all contingencies in the same state of maintenance to the authorized representative of this office. (q) To receive the I.D proof of the visitor and entry of visitor in the register is mandatory. (r) Contractor will not do any illegal activity in the premises. (s) In case of failure, damage charges @ three times of the ordinary rate/prevailing rates shall be levied till the handing/taking over. (t) Additional linen and gadgets will be responsibility of the contractor. Handing/Taking over Handing taking over comprising fittings, linen, crockery, gadgets and all other items shall be properly after an inventory at site and details of each item giving specification duly signed by rep of the Board and the licensee. Verification of stock will be checked quarterly. Damages and losses All the items and equipments at site shall in sole charge of the contractor who shall deliver back in their proper condition at the time of completion of contract or termination of contract whichever is sooner. Any shortage or loss shall be make good within 05 days failing which cost will be recovered from the security. Breakage Breakage of crockery or any other item shall be responsibility of the contractor and item would be replaced by similar specifications and quality. Compliance Contractor shall keep a suggestion book to be provided by the Cantonment Board and make it available to the guest at all times to record any complaint or suggestion. This register will be shown to the rep of the CEO for prompt action and put up weekly before the CEO. Contractor shall attend to all complaint and complete requisite action as early. Indiscipline or misbehavior The employee of the contractor/licensee shall maintain strict discipline and not use any offensive or abusive language and not take any violent action while inside the premises. In case of any such occurrence CEO shall has rights to terminate the contract immediately. Apart from

above necessary legal action as advised by CBLA. In case of termination of contract security money and all other money shall be forfeited. Replacement Replacement of the articles shall be done as per directions of the representative of the Board/CEO or his rep. In case the item is not replaced within schedule time and as per specification same shall be deducted from the security deposit. Penalty On account of unsatisfactory catering services and improper maintenance of guest house a penalty of rupees upto Rs.300/-per day will be imposed by the CEO. The amount may increase on the basis of feedback from the guest upto Rs.500/-. Period of Contract The contract shall be for a period of 03 years provided the same is not terminated due to breach of terms and conditions and unsatisfactory services. Security deposit The contractor shall submit a security deposit equal to six month charges before handing over in the form of fixed deposit in a nationalize bank in favour of CEO or in cash. Security will be released only after 03 months of expiry of the contract period. Termination of Contract The contract may be terminated in any of the following:I. On expiry of the contract period Or II. On one month notice during the period of license. In case the services rendered by the licensee are not found satisfactory in conformity of the contract. Or III. The methodology for issue of such notice shall be as under “If services of the contractor/licensee are not found satisfactory during the period of contract, he will be issued one week notice by the CEO in order to allow an opportunity to make satisfactory improvement. However if satisfactory improvement are not made even after such notice, a final one month notice will be issued by the CEO to terminate the contract without prejudice to any rights accruing to either party prior to such termination. During period of notice both party shall continue to discharge their duties and obligations.” Or IV. For committing breach of any terms and conditions after giving 07 days show cause notice or assigning …………………………… or interest there and by the contractor to any third person for subletting the contract after giving show cause notice of 07days. Or V. On contractor being declared insolvent by the competent court of law after giving show cause notice of 07 days.

It shall be duty of contractor to remove all the persons deployed by him on termination of contract on any ground whatsoever. He shall ensure that no person create any disruption/hindrance of any nature to the Board, otherwise licensee shall be liable to pay damages at the rate of three times of the charges as assessed by the CEO.
