JOINT MOTION TO DISMISS WITH PREJUDICE Appellants Mississippi State Conference NAACP, the Gulf Coast Fair Housing Center, Dorothy McClendon, Pamela Landry, Rangisma Dilworth and Zelda Williams (together, the “Appellants”) and Appellees United States Department of Housing & Urban Development (“HUD”) and Shaun Donovan, in his Official Capacity as Secretary of the United States Department of Housing & Urban Development (together the “Appellees”), have reached a resolution regarding the claims brought in this Action. On the basis of such resolution, which includes a further proposal for the programming of Community Development Block Grant funds submitted by the State of Mississippi to HUD, and approved by HUD on November 8, 2010, to satisfy as yet unmet housing needs caused by Hurricane Katrina’s wind and flooding among, in particular, low- and moderateincome residents of southern Mississippi, Appellants and Appellees have agreed to and hereby jointly do move the Court to dismiss with prejudice Appellants’ appeal in this action. Each party will bear its own costs and attorneys’ fees.
