CONFIDENTIALITY OF CONSUMER POLICY I.
PURPOSE The purpose of this policy is to The Arc of the Capital Area’s position on consumer confidentially.
SCOPE This policy applies to all employees at The Arc of the Capital Area.
POLICY It is the policy of The Arc of the Capital Area that all information, verbal and written, pertaining to Arc consumers is to be treated as privileged, confidential, highly personal information and shall be shared only with employees of The Arc, business associate, consultants, and parents/foster parents/guardians with a legitimate “need to know.” This also applies to records originating with other organizations that are made a part of agency records.
PROCEDURE A. In no case shall information from a consumer’s records be given in any form to persons who are not The Arc of the Capital Area employees or consultants without prior written consent from the parent or guardian, and in the case of adults who do not have guardians, from the adult consumer. Request for reproduced copies of information regarding a consumer of The Arc of the Capital Area shall be made through the responsible case manager or in the absence of the case manager, the program director for the consumer. B. Employees should accept record protection as a prime obligation and should safeguard not only the readable documents in the files, but also the information derived there from. Any unauthorized discussion of case material outside the agency is forbidden. C. Such rules of confidentiality shall also pertain to related information from staffing, planning meetings, professional meetings, conversations, and discussions. The nature of such verbal communication shall be accorded the same confidential treatment as all other records. D. Violation of this policy shall be considered just grounds for termination.
