UNOFFICIAL  MINUTES   MUSCATINE  SCHOOL  BOARD  OF  EDUCATION   REGULAR  SESSION   JANUARY  26,  2015     The  Board  of  Education  of  the  Muscatine  Community  School  District,  in  the  County  of  Muscatine,  State   of  Iowa,  met  in  regular  session  on  Monday,  January  26,  2015  at  7  p.m.  at  the  Muscatine  Community   School  District  Administration  Center.  President  Nathan  Mather  called  the  meeting  to  order.  Directors   Tim  Bower,  Tammi  Drawbaugh,  Brenda  Garcia,  Tom  Johanns,  Randy  Naber  and  Mary  Wildermuth  were   present.  Also  present  was  Superintendent  Jerry  Riibe.  Director  of  Finance  Jean  Garner  was  absent.     The  board  recited  the  Pledge  of  Allegiance.     President  Mather  welcomed  visitors  and  media  representatives.     No  one  spoke  during  Citizens  Speak.     Director  Johanns  asked  that  employment  recommendations  be  pulled  from  the  consent  agenda.     A  motion  was  made  by  Director  Wildermuth  and  seconded  by  Director  Bower  to  approve  the   consent  agenda  to  include  the  following:  the  minutes  of  the  January  12,  2015  regular  meeting   and  the  bills  and  claims  against  the  district  dated  January  26,  2015.  All  ayes;  motion  carried.     Director  Johanns  asked  for  clarification  on  the  Kim  Davis  resignation.  Superintendent  Riibe  explained   that  Ms.  Davis  is  under  contract  as  a  teacher  and  coach  through  the  summer  of  2015  and  that  the  only   vote  asked  of  the  board  is  to  accept  her  resignation.  There  is  no  request  from  the  administration  to   terminate  her  contracts  as  there  is  no  significant  cause  for  such.     A  motion  was  made  by  Director  Johanns  and  seconded  by  Director  Wildermuth  to  approve  the   employment  recommendations  of  the  following:       The  resignation  of  Kim  Davis,  high  school  special  education  teacher  and  head  varsity  softball   coach,  at  the  end  of  the  2014-­‐15  school  year  and  the  resignation  of  Jen  Gibbs  as  assistant  varsity   volleyball  coach  for  the  2015-­‐16  school  year.   The  schedule  C  hires  of  Jacqueline  Kilburn  (effective  January  19,  2015)  and  Ginger  Dahms   (effective  when  a  suitable  replacement  is  found  for  her  current  position)  as  Curriculum   Professional  Development  Leaders.     All  ayes;  motion  carried.     A  motion  was  made  by  Director  Bower  and  seconded  by  Director  Naber  to  approve  the   following  polices:     204.13  Minutes  of  Meetings  of  the  Board     204.15  Public  Hearings     301.01  Superintendent’s  Functions     301.02  Superintendent’s  Evaluations     302.02  Evaluation  of  Administrators     302.03  Job  Description  of  Administrative  Personnel     401.09  Payroll  Periods

401.10  Payroll  Deductions     403.17  Use  of  School-­‐Owned  Vehicles  to  Pull  a  School-­‐Owned  Vehicle     The  board  heard  a  second  reading  on  the  following  policies:     405.08  Transportation-­‐Bus  Mechanics     405.09  Drug  and  Alcohol  Testing  Program     500.00  Statement  of  Guiding  Principles  for  Students     501.03  Entrance  Requirements     501.07  International  Students     503.01  Non-­‐Discrimination  –  Students     503.04  Interviews  with  Students     506.17  Student  Recognition  and  Incentives     804.00  Building  Safety  Audit     805.00  Crisis  Management  and  Response  Plan     Becky  Rodocker,  Interim  Executive  Director  of  Curriculum,  updated  the  board  on  the  district’s  Strategic   Plan  noting  that  the  district  is  either  ahead  of  schedule  or  right  on  target  with  different  parts  of  the  plan.   She  also  shared  the  summer  plans  for  professional  development  and  curriculum  writing.       Jeff  Miller,  Custodial/Maintenance  Supervisor,  provided  an  update  on  the  Jefferson  Elementary   Construction  Project.  He  shared  that  there  has  only  been  nine  change  orders  totaling  $33,000  which  is   very  good  since  most  changes  occur  while  bringing  the  building  out  of  the  ground.  He  noted  that  with   the  early  rains  in  the  summer  and  the  frigid  cold  in  November,  the  project  is  approximately  1-­‐1/2   months  behind  schedule.  It  is  now  estimated  that  the  new  Jefferson  Elementary  will  not  be  ready  for   occupation  until  sometime  in  the  fall  of  2015.     Corry  Spies,  principal  of  Jefferson,  also  shared  that  the  “soft”  costs  are  coming  in  under  what  was   initially  estimated.     Superintendent  Riibe  presented  a  personnel  study  that  he  had  recently  completed  of  all  district  staff.   The  study  included  the  following:  a  comparison  of  district  staff  by  percentage  of  total  workforce,  a   comparison  of  district  staff  by  student  to  staff  ratio,  and  custodial  comparisons  of  staffing  compared  to   square  feet.  He  noted  that  the  study  showed  that  the  district  is  efficiently  staffed  (with  some  areas   understaffed)  and  that  it  is  now  important  that  the  district/board  look  at  efficient  use  of  its  structures   district-­‐wide  in  order  to  meet  budgetary  demands.     President  Mather  provided  the  following  announcements  of  future  meetings  and  events:     February  3,  2015  –  Superintendent’s  Evaluation  at  5:30  p.m.  at  the  Administration  Center.   February  9,  2015  –  Board  Regular  Meeting  at  7  p.m.  at  the  City  Hall.   February  23,  2015  –  Board  Regular  Meeting  at  7  p.m.  at  the  Administration  Center.     February  24,  2015  –  IASB  District  Meeting  at  5:30  p.m.  in  Mount  Pleasant.   April  15,  2015  –  State  Deadline  for  Budget  Certification.     A  motion  was  made  by  Director  Wildermuth  and  seconded  by  Director  Garcia  to  adjourn  the   meeting.  All  ayes;  motion  carried.  Time:  8:15  p.m.     Nathan  Mather,  President   Lisa  Mosier  Bunn,  Secretary     <<6>>

UNOFFICIAL  MINUTES   MUSCATINE  SCHOOL  BOARD  OF  EDUCATION   SPECIAL  SESSION   FEBRUARY  3,  2015     The  Board  of  Education  of  the  Muscatine  Community  School  District,  in  the  County  of  Muscatine,  State   of  Iowa,  met  in  special  session  on  Tuesday,  February  3,  2015  at  5:35  p.m.  at  the  Muscatine  Community   School  District  Administration  Center  for  the  purpose  of  the  superintendent’s  evaluation.  President   Nathan  Mather  called  the  meeting  to  order.  Directors  Tim  Bower,  Tammi  Drawbaugh,  Brenda  Garcia,   Tom  Johanns,  Randy  Naber  and  Mary  Wildermuth  were  present.  Also  present  was  Superintendent  Jerry   Riibe.       The  board  recited  the  Pledge  of  Allegiance.     A  motion  was  made  by  Director  Naber  and  seconded  by  Director  Johanns  to  go  into  closes   session  per  Iowa  Code  Chapter  21.5  (i).  Roll  call:  Ayes:  Directors  Bower,  Drawbaugh,  Garcia,   Johanns,  Mather,  Naber,  and  Wildermuth.  There  were  no  nays.  Motion  passed.  Time:  5:42  p.m.     A  motion  was  made  by  Director  Bower  and  seconded  by  Director  Naber  to  return  to  open   session.  Roll  call:  Ayes:  Directors  Bower,  Drawbaugh,  Garcia,  Johanns,  Mather,  Naber,  and   Wildermuth.  There  were  no  nays.  Motion  passed.  Time:  7:16  p.m.     By  consensus,  it  was  agreed  that  the  board  will  finalize  Superintendent  Riibe’s  evaluation  at  their   February  23,  2015  regular  board  meeting.     A  motion  was  made  by  Director  Johanns  and  seconded  by  Director  Garcia  to  adjourn  the   meeting.  All  ayes;  motion  carried.  Time:  7:17  p.m.     Nathan  Mather,  President   Lisa  Mosier  Bunn,  Secretary

MUSCATINE POLICE DEPARTMENT SCHOOL RESOURCE OFFICER AGREEMENT

THIS AGREEMENT made the 30th day of October, 2014 by and between the Muscatine Police Department and the Muscatine Community School District provides for two School Resource Officers in the 2015-2016 school years.

A. The Muscatine Police Department agrees to: 1. Provide the Muscatine Community School District with two School Resource Officers. 2. Collaborate with the Muscatine Community School District to provide a safe and healthy school environment for students, staff, faculty, and visitors. 3. Commit to providing appropriate programs and services to prevent children from becoming at risk and to intervene when possible with children already in the juvenile justice system. 4. Coordinate with schools to improve training in order to deter incidents of school violence. 5. Attempt to reduce and deter criminal offenses occurring on school property. 6. Promote positive attitudes regarding the police role in society. 7. Assist the superintendent, principals, faculty, and staff in developing plans and strategies to prevent and /or minimize dangerous situations that may occur on school grounds. 8. Be a resource for students which enable them to be associated with a law enforcement figure in the students’ environment. 9. To be a resource for teachers, parents, administrators and students for conferences on an individual basis dealing with issues and questions, particularly in the area of substance abuse and bully/harassment. 10. Coordinate investigative procedures between police and school administrators. 11. Attend school events as necessary or requested. 12. Take appropriate cases action with respect to on-site occurrences, including but not limited to, fights, vandalism, theft, accidents, traffic violations, disorderly conduct, narcotics offenses, weapons, unauthorized persons on school property, and other occurrences as appropriate. 13. Inform school officials and staff of current police involvement with students and/or student’s families. 14. Conduct other duties as approved or assigned by the Chief of Police.

B. Financial Agreement between both parties: The City of Muscatine (City) will provide two officers to work in the Muscatine Community School District (District). The officers will be an employee of the City. The District will provide for 75% of any match and the City will provide for 25% of any match for funding of the officers wages and benefits.

Records of services performed will be maintained by the Muscatine Police Dept. The Muscatine Police Department agrees to maintain records regarding the performance of the School Resource Officers. The Muscatine Police Department will maintain any other records regarding the School Resource Officers. The Muscatine Police Department will maintain all arrest and incident reports generated by the officers.

D. Duration Modification, and Termination of the Agreement: This agreement covers the 2015-2016 school years. At any time either party may request that the agreement modified. Both parties may negotiate any issue. Either party may terminate the Agreement with 30 day written notice to the other party. This agreement constitutes the entire understanding between both parties regarding this subject and no other agreement, oral, or otherwise is in existence or shall be deemed binding upon both parties. This agreement may be amended by written instrument executed by both parties. This agreement will continue to renew yearly unless modifications are needed.

E. Legal Contingencies: It is understood and agreed that this agreement is entered into solely for the benefit of the parties hereto and gives no right to any other party. Each party agrees to be responsible and assumes liability for its own actions and omissions and those of its officers, teachers, or staff for any incident arising out of or in conjunction with this agreement, to the fullest extent required by the law and agrees to save, indemnify, defend, and hold the other party harmless from such liability.

F. Provider Maintains Control Over its Personnel: Members of the Muscatine Police Department assigned as School Resource Officers will not be penalized from exercising the same rights and benefits of other members of the Muscatine Police Department. Employment rights of personnel assigned under a contract for law enforcement services will not be abridged by the provider agency.

G. Use of Equipment and Facilities: The Muscatine School District will provide officer space, office furniture, phone, and access to office equipment. The city will provide training, uniforms, vehicle, and related equipment.

H. Review and Revision of the Agreement, if needed: This agreement is subject to review and revision at the request of either party, if such party given advance written notice to the other party. Upon receipt of the written notice, both parties agree to endeavor towards a mutually beneficial agreement. The Muscatine Police Department will forward a written copy of the new Agreement to the school for review. Any new Agreement becomes effective upon mutual receipt of an Agreement endorsed by the City of Muscatine and the Superintendent of the Muscatine Community School District, or at a date specified within the Agreement.

DRUG AND ALCOHOL TESTING PROGRAM Employees who operate school vehicles are subject to drug and alcohol testing if a commercial driver’s license is required to operate the school vehicle and the school vehicle weighs twenty-six thousand one pounds or more, or the school vehicle transports sixteen or more persons including the driver. For purposes of the drug and alcohol testing program, the term “employees” includes applicants who have been offered a position to operate a school vehicle. The employees operating a school vehicle as described above are subject to pre-employment drug testing and random, reasonable suspicion, postaccident, return-to-duty and follow-up drug and alcohol testing. Employees operating school vehicles shall not perform a safety-sensitive function within four hours of using alcohol. Employees governed by this policy shall be subject to the drug and alcohol testing program beginning the first day they operate or are offered a position to operate school vehicles and continue to be subject to the drug and alcohol testing program as long as they may be required to perform a safety-sensitive function as it is defined in the administrative regulations. Employees with questions about the drug and alcohol testing program may contact the district contact person, the Director of Human Resources. Employees who violate the terms of this policy may be subject to discipline up to and including discharge. Employees who violate this policy may be required to successfully participate in a substance abuse evaluation and, if recommended, a substance abuse treatment program. Employees required to participate in, and who fail to or refuse to successfully participate in, a substance evaluation or a recommended substance abuse treatment program may be subject to progressive discipline up to and including discharge. A second violation of this policy will result in termination. It is the responsibility of the superintendent to develop administrative regulations to implement this policy. Applicants will be informed of the requirement for drug and alcohol testing in notices or advertisements for employment, in the application form, and personally at the first interview with the applicant.

The superintendent shall be responsible for publication and dissemination of this policy and its supporting administrative regulations to employees operating school vehicles. The superintendent shall also oversee a substance-free awareness program to educate employees about the dangers of substance abuse and notify them of available substance abuse treatment resources and programs.

STATEMENT OF GUIDING PRINCIPLES FOR STUDENTS Student Rights and Responsibilities Each student has the opportunity and the right to use school as a means for self-improvement and individual growth. In so doing, each student is expected to conduct his or her affairs in such a way as to assure other students the same opportunities without serving to restrict or otherwise inhibit their individual and collective rights. Enrolled children in the school district community shall have an equal opportunity for a quality public education without discrimination regardless of their race, creed, color, gender, gender identity, marital status, sexual orientation, national origin, religion, age, veteran status or disability. Of equal importance is the right of school authorities to prescribe and control, consistent with fundamental and constitutional safeguards, student conduct in the schools. In exercising this right, each building principal, working with his/her staff and with the students, will attempt to achieve the objectives and follow the procedures set forth by Board policies and administrative regulations pertaining to the various aspects of student rights, student conduct, and student discipline. Objectives to be Achieved The primary objective is the proper recognition and preservation of a student's constitutional rights and allowance for such rights: Freedom of Expression - Students may freely express points of view within the limits of the law provided they do not seek to coerce others to join in their mode of expression and provided also that they do not otherwise intrude upon the rights of others during school hours or the school's educational mission. Personal Appearance - Restrictions on a student's hair style or his/her manner of dress will be determined where there is a "clear and present danger to the student's health and safety, causes an interference with work, or creates classroom or school disorder" as a result of hairstyle or manner of dress. Participation in voluntary activities may necessitate specific requirements for approved grooming and dress due to the nature of the activity.

500(2) The Right to Petition - Students are allowed to present petitions to the administration at any time. Collection of signatures on petitions is limited to before and after school hours. No student will be subjected to disciplinary measures of any nature for signing a petition addressed to the administration, assuming that the petition is free of obscenities, libelous statements, personal attack, advocation of disruption which poses a probable threat of disruption to the regular school program, and is within the bounds of reasonable conduct. Student Due Process Rights - Students are to have clearly established means by which "administrative due process" is available to see that the individual's rights are protected. Students are to be involved, singly and collectively, as citizens of the school with the attendant rights of such citizenship and corresponding responsibilities for the proper conduct of their own affairs and those of other students.

ENTRANCE REQUIREMENTS

Below is taken from IASB’s policy manual: Children in the school district community will be allowed to enroll in the school district's regular education program beginning at age five [5]. The child must be age five [5] on or prior to September 15 to participate in the school district's kindergarten program. The child must be age six [6] on or prior to September 15 to begin the first grade of the education program (added from ISFIS Policy Procedure for Attendance in italics): except that a child under six [6] years of age who has been admitted to school work for the year immediately preceding the first grade under conditions approved by the department of education, or who as demonstrated the possession of sufficient ability to profit by first-grade work on the basis of tests or other means of evaluation recommended or approved by the department of education, may be admitted to first grade at any time before December 31. Added per request: Per federal law, children of military families must be enrolled in the grade of the prior school regardless of age. Continued from our original policy using suggestions from others: A general education student shall not be admitted to preschool unless he or she is four years old on or before September 15 of the current year. Handicapped preschool (Early Childhood Special Education, ECSE) and at risk programs are provided for students at a younger age when they have met criteria established by the school district and the State of Iowa must be four [4] years old on or before September 15 of the current year to be admitted to the Statewide Voluntary Preschool Program. Appropriate placement of preschool students with Individualized Education Plans (IEP) will be determined on an individual basis. A general education student must be three [3] years old on or before September 15 of the current year to be admitted to the Statewide Voluntary Preschool Program. Continued from IASB’s policy manual: The board will require evidence of age and residency in the form of a birth certificate or other evidence before the student may enroll in the school district's education program. It is within the discretion of the superintendent to determine what is satisfactory evidence for proof of age. Prior to enrollment, parents must provide the administration with their child’s health and immunization certificate. Failure to provide this information within the time period set by the superintendent is reason for suspension, expulsion or denying admission to the student. A student shall not be admitted to kindergarten unless he or she is five years old on or before September 15 of the current year. A student shall not be admitted to first grade unless he or she is six years old on or before September 15 of the current year. Continued from our original policy: The principal shall determine the grade in which the student shall be classified.

INTERNATIONAL STUDENTS Foreign students shall meet all district entrance requirements including age, place of residence and immunization. The Board reserves the right to limit the number of foreign students accepted. Students who are citizens of a foreign country will be considered residents if they meet one of the following requirements:

NON-DISCRIMINATION (STUDENTS) It is the policy of the Muscatine Community School District not to discriminate on the basis of race, creed, color, gender, gender identity, marital status, sexual orientation, socio-economic status, national origin, religion, age, veteran status or disability in its educational programs, activities or employment practices. The Board of Education and district staff will make every effort to provide comparable opportunities to students to participate in school-sponsored activities and programs. INTERVIEWS WITH STUDENTS A student may not be interviewed in school unless the principal or another delegated staff member has granted permission. Permission shall not be granted unless the principal deems it essential to the welfare of the pupil or he/she is directed to do so by court order and is assured of proper identification of person(s) requesting the interview. No student may be taken from the school without the consent of the building principal. The administration and staff will cooperate fully with DHS personnel in conducting a child abuse investigation by providing confidential access to the child named in the report, and to other children alleged to have relevant information, for the purpose of interviews. The district recognizes no obligation to contact the parents or guardians of a child suspected to be a victim of abuse. If police officers or other officials request an interview, an attempt shall be made to contact the student's parents or legal guardian and to have one of them present during the interview.

Student Recognition and Incentives The Board of Education believes that recognizing students for academic, behavioral, and co-curricular achievements enhances the student’s school experience and thus serves a public purpose. Special recognition programs and incentives for students in the Muscatine Community School District may be planned and held throughout the year. Expenses associated with these programs may include refreshments, certificates, letters, ribbons, pins, pencils, and other items deemed de minimis in nature and are age appropriate.

BUILDING SAFETY AUDITS The District will conduct a safety audit of all facilities and related safety and security policies and procedures on an annual basis. The audit will include a walk through of buildings and grounds, play areas, vehicle and parking areas, and a review of safety and security policies and procedures. A safety audit checklist will be utilized to set standards and provide benchmarking for year-to-year comparisons. Intervention and prevention plans and student handbook discipline and dress code guidelines will also be reviewed as part of the process. The audit will be conducted in collaboration with local emergency responders (police, fire, etc.). The results of the audit and recommendations for improvement will be reported to the Superintendent and Board of Education for action

CRISIS MANAGEMENT AND RESPONSE PLAN The District will develop a Crisis Management and Response Plan in collaboration with local emergency responders (police, fire, etc.). The plan will include the following components: • • • •

A district Safety Committee will be established and given the responsibility of reviewing the plan annually. The results of the review will be reported to the Superintendent and the Board of Education with recommendations for revision and improvement. Copies of the plan will be kept in each building. The plan will be included in the district’s Comprehensive School Improvement Plan (CSIP) and will serve as a guideline or crisis prevention, management, intervention and recovery.
