MONTHLY PROGRESS REPORT For month ending July 31 2000 CV-97-0206 (D.N.M) Albuquerque v. Sparton Technology, Inc. 08/03/00

Tasks Completed: Groundwater Monitoring Plan Reviewed the draft semi-annual annual progress report. Relieved pressure on all monitoring wells. Public Involvement Plan The Public meeting was held July 6th at 7:00pm at 1510 Ellison Drive NW. Attendees included Representatives from the NMED (and HMB), City of Albuquerque (Public Works, Health Dept.), Melloy Dodge, and 5 members of the Public. The meeting started at 7:00pm and was finished by 8:15pm. All questions raised were addressed completely and to everyone's satisfaction. Action items included proposing to EPA that a small map be included with next years information letter showing the most recent available plume boundary. Offsite-Containment System The system ran 100% of the time, and pumped 10,150,400 gallons (average of220 gpm). Continued to work on the proposed contract with US Filter (Chromium treatment). Assessment of Aquifer Restoration

Soil Vapor Extraction System. Melloy Dodge continues remodeling buildings at 9621 Coors Boulevard NW. Additional noise abatement measure on July 5th included adding two mufflers to the exhaust stacks. The noise level was further reduced. The 400 CFM blower system ran 90% of the time this month. Remodeling activities resulted in 72 hours of system down time (July 21 st_24th). Source Containment System Pursued permitting issues: These included o The application for water rights with the State Engineers Office was obtained July 13th. o The USBR misplaced the application for the water rights lease with the Village of Los Lunas (Applied 2/7/00). Reapplied mid July. o It is believed that all issues have been resolved for the following, and the license agreements are expected in mid August.

The license agreement for an easement crossing with the City of Albuquerque for the well pipeline (Applied 4/6/00). A license agreement for an easement crossing with AMAFCA for the well pipeline (Applied 4/6/00).

Changes were made to the Financial Assurance submission per comments received and the plan was issued mid July.

Tasks Planned: Groundwater Monitoring Plan Quarterly monitoring of the wells. Meet with the Contractor and Engineer on the SAD protection issues.
