Contract Award, IFB 2015-1305 BRT Advanced Utilities Relocation.

ACTION ITEM RECOMMENDED ACTION(S): Consider approving contract award to McGuire and Hester for Advanced Utilities Relocation in support of the East Bay Bus Rapid Transit (BRT) project. EXECUTIVE SUMMARY: The District sought firm fixed price bids from qualified firms to relocate sewer lines, manholes, East Bay Municipal Utilities District (EBMUD) waterlines, gate valves, fire hydrants and other appurtenances as required, clearing the proj ect area of any conflict with the future construction of bu s lanes and platforms of the East Bay Bus Rapid Transit Project in the Cities of Oakland and San Leandro. A total of three hundred and thirty nine {339} firm s were solicited for this procurement, including

31 small local business enterprises (SLBEs) and 290 di sadvantaged business enterprise (DBE) firm s. Further, the District instituted a 20% SBE goal. The District received three (3) timely bid s, of which two were deemed responsive and responsible. The recommended firm is McGuire and Hester, with the lowest responsive and responsible base bid of $7J00,894. They have committed to 20% SBE utilization, which includes SLBE participation of 18% and DBE participation of 10%, the latter of which being two (2) percentage points higher than the District's FTA-approved overall DBE goal of8%. BUDGETARY/FISCAL IMPACT: This procurement will be fund ed from existing BRT project funds as shown in the table : Regional Measure 2

The District's 9.5 mile long East Bay BRT project is designed to provide superior public transit through one of the District's busiest corridors. The BRT service will feature 5-minute head ways, light-rail-like bus stations with ADA compliant passenger amenities, Traffic Signal Priority (TSP) for advancing buses through signalized intersections, passenger safety features, diesel-electric hybrid, dual sided 5-door buses, dedicated bus lanes, and improved lighting and passenger facilities. District has determined that three (3) contract packages using the Design/Bid/Build delivery option will be the most cost effective option for constructing the East Bay BRT project. The Advanced Utilities Relocation Project is first of the three contract packages. The Advanced Utilities Relocation project will clear the project area of sanitary sewer and waterman conflicts with the future construction of bus lanes and platforms of the East Bay Bus Rapid Transit Project in the Cities of Oakland and San Leandro. A total of three hundred and thirty nine (339) firms were solicited for this procurement. This total includes 31 SLBE and 290 DBE firms notified of the procurement. Further, the District instituted a 20% SBE goal based on an availability analysis of SBEs in this industry with this procurement. Additionally, this solicitation was posted on the District's website and advertised in The Oakland Tribune on 9/16/14 and 9/25/14. The District also posted in the Alameda Builder's Exchange, Contra Costa Builder's Exchange, Oakland Chamber of Commerce and Berkeley Chamber of Commerce; and as with other District postings, this solicitation was linked and posted to the Oakland African-American Chamber of Commerce and the Hispanic Chamber of Commerce of Alameda County. The District received three (3) timely bids: McGuire and Hester, Ghilotti Construction, and Ranger Pipelines. The bids from McGuire and Hester and Ghilotti Construction were deemed responsive and responsible. The third bid from Ranger Pipelines which was deemed unresponsive and responsible since required Contract Offer and Acceptance Form and Prompt Payment Affidavit were missing from their bid packet submittal.

McGuire and Hester is the

recommended firm with the lowest responsive base bid, and has committed to 20% SBE utilization, 18% SLBE participation, and 10% DBE participation. McGuire and Hester possess the state licenses required for the project and are not on any state or Federal debarment list.

ADVANTAGES/DISADVANTAGES: The Advantages of awarding the Project construction contract include: •

Allows for more direct control by the District of the project construction budget, and schedule.



Stakeholder agencies believe it will take less time to complete the project through an outside party, versus constructing the project internally by the Cities.



This contract establishes a fair competition for all firms, transparency in awarding contract, and equal opportunity to small business enterprises.



Accountability to the stakeholder agencies associated with construction in the public right-of-way.

ALTERNATIVES ANALYSIS: The Board could choose to reject all bids and re-solicit the construction contract in a new IFB. This would substantially delay construction of the project and the revenue service date.

PRIOR RELEVANT BOARD ACTIONS/POLICIES: Staff Report 14-054- Authorizing the General Manager to sign the Utility Agreements with PG&E, AT&T and EBMUD. ATTACHMENTS: None.
